    What is a Toxic Chemical Permit?

    A toxic chemical permit is an authorization system under Ukrainian legislation that regulates processes such as the production, import, storage, transportation, and use of hazardous chemicals. The aim of the toxic chemical permit is to protect human health and the environment from the adverse effects of such substances.

    How does the Toxic Chemical Permit process work?

    1 – Pre-registration and registration processes

    According to Ukraine REACH, companies that produce or import 1 tonne or more of a chemical substance per year into Ukraine are required to register these substances. For more details, you can read our related article.

    2 – Required documents and filing

    During the application process, companies are expected to submit a set of documents and a technical dossier. These typically include:

    • Technical dossier

    Contains detailed information on the physical, chemical, toxicological, and ecotoxicological properties of the chemical substance.

    • Chemical Safety Report (CSR)

    For chemicals exceeding a certain annual tonnage, the CSR is a comprehensive report explaining the safe use of the substance and its risk management measures.

    • Safety Data Sheet (SDS)

    An SDS prepared in the official language of Ukraine, containing information on the hazards of the chemical, safe handling instructions, and emergency measures, is also required.

    • Only Representative Appointment

    Non-Ukrainian manufacturers must appoint an Only Representative to manage the registration process and follow regulatory requirements.

    3 – Evaluation and permit process

    The Ministry of Environmental Protection and Natural Resources of Ukraine (MEPR) reviews the submitted files. For hazardous substances and high-risk chemicals, additional assessments and authorizations may be required. If the application meets all requirements and the chemical is proven safe, the relevant permit or authorization is granted.

      Which chemicals require a permit?

      The requirement for a permit depends on the hazard classification of the chemical. In particular, hazardous chemical substances require a permit if they can cause acute or delayed severe poisoning, leading to illness, disruption of the body’s systems or death when ingested orally, gets on the skin or is inhaled.

      A CSR is mandatory for chemicals produced or imported in quantities of 10 tonnes or more per year.

      The validity period of a permit for the use of a toxic chemical substance is three years. In general, a renewal application must be submitted before the permit expires.
